Privacy Policy

The board of directors, management, and staff of the EngCap Group of Companies (“EngCap"), recognizes and respects their clients’ personal information and endeavor to safeguard that information from unauthorized use, retention, or disclosure to third parties. It is upon this fundamental principle that our firm adheres to the protection of our clients’ personal information as governed by EngCap's privacy policy (the “Privacy Policy”), as follows:


EngCap's Privacy Policy assures you that the entire EngCap team will handle your information in accordance with this policy and pursuant to all applicable Federal and Provincial legislation including, but not limited to, the Personal Information Protection and Electronic Documents Act (“PIPEDA”).

Scope of the Privacy Policy

This Privacy Policy governs personal information collected directly from our clients, prospective clients, or interested parties, (collectively known as "Clients"), as well as information received from other organizations that have information relevant and necessary to fulfilling the purpose for which our firm’s services have been retained.


Personal information is defined under PIPEDA as any information that is identifiable or directly attributable to an individual. It does not cover information about an individual that is available from a public source, such as a telephone directory, court record, or land registry office. It also does not cover aggregated data, used for statistical and reporting purposes, from which data the Client’s identity cannot be determined.


This Privacy Policy applies to EngCap's board of directors, management, staff, and all contracted entities. As well, EngCap ensures that all third party service providers sign confidentiality agreements prior to any transfer of a Client’s personal information in the course of providing the services for which EngCap was retained.

Purposes for Collecting Personal Information

EngCap collects personal information for the following limited purposes:


  1. to provide services to a Client:

  2. to establish and maintain Client lists for record keeping, business development, and statistical purposes;

  3. to establish and maintain mailing lists for newsletters, event notification, or legal updates that EngCap believes might be informative or beneficial;

  4. to respond to questions, comments, and other general inquiries; and

  5. Google Analytics: We use Google Analytics to track visitors to our sites. Google Analytics uses cookies to collect this data. Please see Google's respective policies.

Consent to the Collection, Use, and Disclosure of Personal Information

When a client, prospective client, or interested party completes an online form, or otherwise provides EngCap with personal information, he or she consents to EngCap collecting, using and disclosing personal information obtained for the limited purpose for which EngCap was engaged, as well as those purposes listed above in this Privacy Policy.


EngCap will not use Client personal information for any purposes other than that consented to by the Client, either by express or implied consent. EngCap does not sell, barter, or lease personal information it obtains from its Clients to any third parties except as explicitly described in this Privacy Policy.


Under PIPEDA and other Federal and Provincial Legislation, EngCap may disclose personal information without Client consent to:


  • government or legal enforcement agencies if the information has been provided for fraudulent or illegal purposes;

  • government or legal enforcement agencies if the information is collected in the midst of a criminal investigation;

  • legal enforcement agency if EngCap determines that there is imminent risk of death or serious bodily harm, including psychological harm, to an identifiable person or group of persons;

  • disclosure to a third party individual or organization if so ordered by a Court or Tribunal of competent jurisdiction; and

  • defend against allegations of criminal or civil liability, or malpractice or misconduct, by the Client or any other party.

Accuracy of a Client’s Personal Information

EngCap endeavours to ensure that all personal information provided and in its possession, is accurate, current and as complete as is necessary for the purposes for which the personal information was collected. Upon notification that the personal information requires correction or updating, EngCap will make the necessary amendments to the active file where applicable.

Retention of the Client’s Personal Information

EngCap will retain personal information until the matter is closed or as requested by the Client.


  • Any closed files are retained for the period prescribed by relevant Federal and Provincial legislation.

Safeguards

EngCap has implemented a number of physical, organizational, and technological safeguards appropriate to the sensitivity of the Client’s personal information, including but not limited to:


  • Physical - All Client data are maintained in areas where access is restricted to authorized personnel only. Highly sensitive information such as financial account information, estate information, and other physical documents, are stored in a locked cabinet with no available access to anyone but those individuals within EngCap possessing the required authorization.

  • Organizational - Only EngCap personnel will have access to the personal information. Any third party individual or organization is required to sign a non-disclosure agreement prior to the Client’s personal information being transferred to a third party as required to fulfill the purposes for which EngCap was retained.

  • Technological - EngCap utilizes a current firewall, virus protection, and other technological safeguards to protect personal information that is retained on the company's network.


Regarding electronic transmission of personal information (i.e. email), there is no method of transmitting or storing data that is completely secure. EngCap uses available and reasonable technological security in the transmission of any Client’s personal information. Notwithstanding these technological safeguards, all Internet transmissions are susceptible to possible loss, misrouting, interception, and misuse.

Amendments to the Privacy Policy

This Privacy Policy is in effect as of May 1, 2019. Further, this Privacy Policy is subject to amendment in response to any developments in privacy legislation. EngCap may review and revise this Privacy Policy from time to time.
